I previously wanted to apply for the Tier 1 visa for highly skilled migrants, but did not qualify as I did not have a Master’s degree. I have however been told that the criteria has recently been changed?

A: The new criteria to apply for initial applications under the Tier 1 (General) scheme came into effect on 6 April 2010.

The good news is that with the new criteria one no longer requires a Master’s degree in order to qualify for this type of visa. In order to qualify, applicants only need to show that they are able to score at least 75 points for their attributes, 10 points under the category for English language and 10 points under the maintenance criteria. The 75 points for attributes can be obtained under the following sub-categories: age, qualifications and previous earnings, and points can also be earned if previous earnings or qualifications have been gained in the UK.

Successful candidates in this category will be granted an initial period of three years leave. An extension of leave in this category will be granted for two years if the general criteria can still be met, which will take the applicant to the qualifying period of five years for permanent residence in the UK.

The Tier 1 permit is one of the most advantageous permits available, as Tier 1 (General migrants are able to work in the UK without any restrictions (subject to the extension of leave criteria, and restrictions on doctors in training). You will also be able to be self-employed or even combine employment and self-employment.
