How Oscar’s sentencing will work

<p style="margin: 0cm 0cm 10.5pt; line-height: 14.7pt; vertical-align: baseline; background-image: initial; background-attachment: initial; background-position: initial; background-repeat: initial;"><span style="font-family: Arial, sans-serif; font-size: 10.5pt; line-height: 14.7pt;">Although judgement proceedings for former Paralympic star Oscar Pistorius in the shooting and killing of his girlfriend Reeva Steenkamp will start on Monday, 13 October, this by no means mean he will know his fate soon. <p style="margin: 0cm 0cm 10.5pt; line-height: 14.7pt; vertical-align: baseline; background-image: initial; background-attachment: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 10.5pt; font-family: Arial, sans-serif;">Judge Thokozile Masipa (above) will first need to hear defence witnesses who will testify on why Pistorius should not serve time behind bars. They may call as many witnesses and experts from various fields as they deem necessary unless the State is successful in objecting to any of them testifying. Then the State will have its turn to call witnesses to testify on why he should serve a heavy penalty.

How Oscar’s sentencing will work

Pistorius has already been found not guilty of murder – a ruling that has seen Masipa being criticised for not interpreting the definition of murder correctly. However, the current conviction of culpable homicide crucially – for Pistorius – does not have a prescribed sentence. It is at the discretion of the judge.

 After the judge has heard both submissions, she will in all likelihood take a few days (it could even be weeks) off to consider her sentence. Only after she has handed down the sentence will any of the parties be allowed to appeal.
